In 2005, the US Supreme Court held in United States v. Booker, that the code violated the Sixth Amendment Right to Jury Trial and Congress was forced to remove the illegal provisions. Today, the guidelines are treated as advisory. The Supreme Court’s decision did not affect state court sentencing guidelines. Federal judges must now calculate a guidelines sentence and consider it but are not bound but its recommendation.
